Transport worker gets $10k after boss underpays hourly rate

Tasmanian transport worker back-paid $10,300 after an investigation found he was underpaid

May 27, 2010

A Tasmanian transport worker has been back-paid $10,300 after an investigation found he was underpaid.

The Fair Work Ombudsman found the Devonport worker was not paid the correct hourly rate.

Following a complaint to the Ombudsman, inspectors contacted the man’s employer and requested reimbursement.

Fair Work Ombudsman Tasmania Director Glenn Jordan says the underpayment was inadvertent and resulted from the employer’s lack of understanding of its responsibilities under the relevant award.

“Employers need to be fully aware of all the provisions in their award which affect their workers,” Jordan says.

“The Fair Work Ombudsman can assist employers to better understand and comply with workplace laws.”

Jordan says employers who accidentally breach the law will not always be prosecuted if they voluntarily pay what is owed to their workers.

The Ombudsman does not name offenders unless legal action is launched.
