FWO recovers $33k in back-pay for drivers


Eighteen NSW truck drivers reimbursed more than $33,000 after investigation by the Fair Work Ombudsman found they were underpaid

Eighteen truck drivers at Richmond Valley, NSW, have been reimbursed more than $33,000 after an investigation by the Fair Work Ombudsman (FWO) found they were underpaid.

The truck drivers – all from the same company – were underpaid their overtime entitlements for shift work.

After Fair Work inspectors contacted the employer and explained its obligations, the workers were immediately back-paid.

The FWO randomly audited the company as part of the agency’s regular auditing activity.

FWO NSW Director Mark Davidson says the underpayments were inadvertent and given the employer co-operated and rectified the matter, there will be no further action against the company.

"We have a flexible, fair approach and our preference is always to work with employers to educate them and help them voluntarily rectify any non-compliance issues we identify," he says.

"Underpayments like this illustrate why the Fair Work Ombudsman places such as strong focus on educating employers and assisting them to understand and comply with workplace laws."

Throughout 2010, the FWO will visit up to 10,000 NSW employers who are entering the national workplace relations system for the first time to provide practical information and resources.
