Truckie jailed over fatal crash

Victorian truck driver who ran a red light and killed two children has been jailed

February 4, 2011

A Victorian truck driver who ran a red light and crashed into a car killing two children has been jailed on appeal.

Brett Anthony Janson walked away from the Victorian County Court last June with a three-year suspended sentence and a two-year community based order with 250 hours’ community work.

The Director of Public Prosecutions appealed the decision. Janson, of Bairnsdale, has been resentenced to four years jail with a minimum of two years.

Lyton Mustafovski, 10, and his cousin Jeton Kulofsovski, six, were killed in the 2008 crash when Nejmie Mustafovski’s car was hit by Janson.

Janson pleaded guilty to two counts of dangerous driving causing death and three counts of dangerous driving causing serious injury.

The court heard Janson was looking for a turn-off and not concentrating when the crash happened.

He had diverted his attention from the road for about 10 seconds while travelling 70km/h in an area where he knew there was an intersection, creating a risk of death or serious injury, the court ruled.
