New towing vehicle speed rule to start tomorrow in Victoria

The VACC has issued a reminder for all Victorian operators to follow the new road safety law for roadside workers and tow truck operators

The Victorian Automotive Chamber of Commerce (VACC) is reminding all motorists and operators that a critical safety rule protecting roadside workers will come into force from tomorrow.

From July onwards, the expanded Road Rule 79A comes into effect, requiring drivers to slow to 40km/h when passing stationary or slow-moving towing and roadside assistance vehicles that display flashing lights with workers present on the roadside.

VACC CEO Peter Jones says the timing is crucial as motorists prepare for the upcoming school holidays and increased travel.

“With the school holidays approaching and more Victorians taking to the roads, it’s vital that drivers understand this new rule before it comes into effect on Tuesday,” Jones says.

“This isn’t just about compliance, it’s about protecting the lives of the people who come to our aid when we need roadside assistance.”

The expanded rule will cover accident towing vehicles, breakdown towing services, roadside assistance vehicles and incident response services—extending the same protections already in place for emergency and law enforcement vehicles.

“Our members are looking forward to having the same safety protections that emergency services have had in place for years,” Jones says.

“Every day, towing operators risk their lives working centimetres from passing traffic. This rule change means they can focus on helping stranded motorists rather than constantly watching for approaching vehicles.”

The 40km/h speed limit applies on all road types, including freeways, and is consistent with existing speed restrictions in school zones and roadwork areas.

Jones says that the rule requires drivers to slow down regardless of the posted speed limit when approaching these vehicles.

“Whether you’re on a suburban street or a freeway, if you see flashing lights on a towing or roadside assistance vehicle with workers present, you must slow down to 40km/h until you’ve safely passed,” he says.

“We encourage all Victorian drivers to familiarise themselves with this rule over the weekend. It takes just a moment to slow down, but it could save a life.”

VACC has been advocating for this safety measure for several years, working closely with the Department of Transport and Planning to secure the rule change.

Penalties for non-compliance with Road Rule 79A include fines and demerit points, with enforcement beginning from tomorrow.
